Petroleum (Flammable Liquids and Fuels) Licensing

Licensing of Flammable Liquids and Fuels is under the provisions of the Dangerous Substance Act 1972 (No. 10 of 1972) and Regulations 2019

Kerosene (Category 2) and Diesel (Category 3 Flammable Liquid) were declared a Dangerous Substance under the Dangerous Substance Act 1972 (Part IV Declaration) Order 2020 and as such a licence is required when stored as set out in the Regulations.

 

There are two sets of Regulations as follows:-

 

Regulation S.I. No. 630 of 2019

These Regulations may be cited as the Dangerous Substances (Flammable Liquids and Fuels Retail Stores) Regulations, 2019.

These Regulations repeal and replace the Dangerous Substances (Retail and Private Petroleum Stores) Regulations, 1979 (No. 311 of 1979).

These Regulations came into operation on 1 April 2020.

Private Stores are now Regulated under the Distribution and Commercial Supply Regulations (S.I. 631 of 2019)

 

Regulation S.I No. 631 of 2019

These Regulations may be cited as the Dangerous Substances (Flammable Liquids and Fuels Distribution and Commercial Supply Stores) Regulations, 2019.

These Regulations repeal and replace the Dangerous Substances (Petroleum Bulk Stores) Regulations, 1979 (No. 313 of 1979).

These Regulations came into operation on 1 April 2020.

You can return the Schedule 2 Application form, duly completed, to cfo@kildarecoco.ie together with the items as set out in the Licences (General Provisions) section of the Regulations.

Please note that a completed electrical certificate in the format set out, in the publication listed in Schedule 1, part 1, of the Regulations (ie The Blue Book) along with a site specific risk assessment, prepared in accordance with the Regulations by a competent person, is also required to accompany the application.

A competent person is defined in Regulation 2 and should possess sufficient training experience and knowledge appropriate to the work along with taking account, as appropriate, of the framework of qualifications referred to in the Qualifications Act 2012.

It is the responsibility of the licensee or owner or operator of a store, to ensure that the person engaged to carry out a risk assessment meets the criteria of a competent person as defined in Regulation 2.

 

Licence Fees

The current fee is as outlined in S.I.301 of 1979, Petroleum Licensing Application Requirements & Fees, plus a non-refundable administration charge of €200 in respect of a licence
