Cllr says Sallins Road development is 'illegal'

NAAS, 25 September: by Brian Byrne. A Naas councillor has called for a Cessation Order to be served on a Sallins Road development 'until all relevant legislation has been complied with'.

Cllr Pat McCarthy says the Baba Exports development, which is partly on the site of the former Naas UDC Car Park (above), constitutes 'an illegal development' under the Planning Acts.

His move follows revelations in July by KNN that key procedures in relation to modification of planning conditions had apparently not been followed by town officials (see stories below).

And Cllr McCarthy also says that no Commencement Certificate for the development has been issued by the Building Control Section of Kildare County Council. "This Certificate cannot be issued at present because the County Fire Officer has not issued a Fire Safety Certificate," he says in a letter sent this week to Naas town clerk Declan Kirrane.

In the letter, Cllr McCarthy asks 'what steps have been taken to enforce a key planning condition' on the developoment.

The condition required for the provision of a temporary car park on the site by the developer before construction work started on the site of the old UDC Sallins Road car park.

Cllr McCarthy asks if the condition is not to be enforced, were all the necessary steps taken under the Planning Acts when a planning permission condition is to be revoked? (A similar emailed query from KNN last July to town manager Tommy Skehan has so far not been replied to.)

“I don’t think that the UDC should allow any developer to drive a coach and four through the Planning Laws, as is happening in this case,” says Cllr McCarthy. “In my humble opinion, the Planning Laws are there in the interest of the common good and irrespective of whether the project involved is a multi-million pound one, or a small extension to a home, the same rules must be applied.”
