'Litigation ultimatum' for Naas Mayor

10 October 2003: The residents of Arconagh have given the Mayor of Naas until 16 October to inform them what progress has been made in taking their estate in charge by Naas Town Council, so as to 'forestall any litigation' over the issue.

In a letter this week to Cllr Pat O'Reilly, Arconagh Residents Association secretary Vincent Naughton warns the Mayor that it is likely any costs of such litigation 'would be fixed entirely' on the Town Council.

In June, the Association invoked Section 180 of the Planning and Development Act 2000 which makes it mandatory that the estate be taken in charge. But Mr Naughton notes in his latest letter to the Mayor tha 'without your assistance by way of information, we have no way of knowing whether that duty is in fact being performed'.

The residents are contemplating High Court mandamus proceedings to compel the Town Council to comply with its legal obligations.

The taking in charge has been a contentious issue for a number of years, involving ongoing discussions with the developer over sewerage and other problems.
