Material Contravention of Kildare Town Local Area Plan

MATERIAL CONTRAVENTION OF THE KILDARE TOWN

LOCAL AREA PLAN 2012-2018

Planning Register Reference 17/1212

Notice is hereby given in accordance with Section 34 (6) of the Planning & Development Acts 2000-2017 that Kildare County Council intends to consider deciding to grant permission to Value Retail Dublin Ltd. for a development proposed under Planning Register Reference 17/1212 for planning permission at Grey Abbey Road, Kildare Town, Co. Kildare.

The proposed development consists of the provision of 375 no. car parking spaces with pedestrian and vehicular access from Grey Abbey Road and pedestrian and emergency vehicle only access from Tully Road and all ancillary site services, ground works, lighting, landscaping, site development works, at site (1.84ha) adjacent to Aldi store, at Grey Abbey Road, Kildare Town, Co. Kildare.

The development would contravene materially Land Use Zoning Objective F (Open Space and Amenity) of the Kildare Town Local Area Plan 2012-2018 the zoning objective for which is;

‘To protect and provide for recreation, open space and amenity provision’

This zoning objective covers both private and public owned open space dispersed throughout the town. The aim of this land use zoning objective includes, to protect, improve and provide for recreation, open space and amenity provision; to protect improve and maintain public open space and to provide recreational and sports facilities.

The Council will not normally permit development that would result in a loss of open space within the town except where specifically provided for in this Plan. Existing agricultural uses in open space areas will continue to be permitted, and reasonable development proposals in relation to this use will be considered on their merits’.

Submissions or observations may be made not later than 5.00 p.m. on Tuesday 8 May 2018 to Ken Kavanagh, Senior Executive Officer, Planning Department, Kildare County Council, Áras Chill Dara, Devoy Park, Naas. Any submission or observation received regarding the making of a decision to grant permission will be duly considered by the Planning Authority.
