ROAD TRAFFIC AND CAR PARK BYE-LAWS 2002
Athy Town Council, (hereinafter referred to as “the Council”) in exercise of the powers conferred on them by Section 101 of the Road Traffic Act, 1961, (No. 24 of 1961), as amended by Section 6, of the Road Traffic Act, 1968 (No. 25 of 1968) and Section 36 of the Road Traffic Act 1994 and Section 37, the Local Government Act, 1994, hereby makes the following Bye-Laws as to the use of the public roads and car parks, adjoining the public roads, as set out in the schedule to these bye-laws.
Included in these Bye-Laws are:
1. Short Title
These Bye-Laws may be cited as the Athy Urban District Council, Parking Bye-Laws, 2002.
2. Commencement
These Bye-Laws shall come into operation on the 1st February, 2002.
3. Area of Application
These Bye-Laws apply to the area comprising the Athy Town Council Administrative Area.
IN THESE BYE-LAWS:
4. Interpretation
“Car Park” means each of the car parks provided by the Council adjoining the public roads as set out in the Schedule to these Bye-Laws.
“Public Road” means each of the public roads as set out in Schedules I to VII of these Bye-Laws.
“Business Hours” means the period commencing at 8.30 a.m. and terminating at 6.30 p.m. – Monday to Saturday inclusive.
“Casual Trading” has the meaning assigned to it by Section 2 of the Casual Trading Act, 1995.
“Holiday” means Good Friday or any day that is a public holiday for the purpose of the Holiday (Employees) Act 1973, (No. 25 of 1973) as amended.
“Authorised Person” has the meaning assigned to it by Section 103(8) (inserted by the Road Traffic Act 1968) (No. 25 of 1968) of the Road Traffic Act 1961.
“Traffic Warden” has the meaning assigned to it by Section 2 of the Local Authorities (Traffic Wardens) Act 1975 (No. 14 of 1975).
“Ticket Parking Area” means an area on a public road or car park, where a traffic sign authorised by the Signs Regulations together with an accompanying information plate(s) indicates or indicate that parking of vehicles is permitted subject to the exhibition of pay and display parking ticket.
“Parking Bay” means a space in a car park or public road intended for the parking of one vehicle and so indicated by surface or other signs or markings, or where the space is intended for the parking of motorcycles, more than one vehicle.
“Pay & Display Parking Ticket” means a parking ticket issued by the Council by means of a pay and display parking ticket machine which contains the following particulars:-
(a) the words “Athy Town Council”
(b) the fee paid in respect of the ticket
(c) the date and time of issue of the ticket
(d) the time of expiry of the ticket
(e) the street or zone where the ticket is issued
“Pay and Display Parking Ticket Machine” means a machine capable of automatically delivering a pay and display parking ticket when the appropriate parking fee prescribed by these Bye-Laws is inserted into the machine.
“Information Plate” means a plate accompanying a traffic sign which indicates the period during which the restrictions or prohibition indicated by such traffic sign applies.
“Loading Bay” means that portion of a road indicated by means of a traffic sign on which at certain times a vehicle other than goods vehicle being used by loading or unloading shall not be parked.
“Appropriate Fee” means the fee, prescribed in these Bye-Laws, for the ticket parking area, as appropriate in which the vehicle is parked.
“Disabled Persons Parking Permit” means a permit granted in accordance with Article 43 of the Regulations of 1997.
“Valid Pay and Display Parking Ticket” means a pay and display parking ticket, which has not expired.
“Ticket Parking Place” means a place on a public road or car park which is in a ticket-parking area.
These Bye-Laws apply to the car parks mentioned in parts 1 and 2 of the Schedule of Car Parks to these Bye-Laws subject to the exception that Bye-Laws numbered 5 to 10 inclusive shall not apply to the car parks mentioned in Part 2 of the said Schedule.
5. Length of Stay
Notwithstanding anything contained in Bye-Laws, a vehicle shall not be parked in a car park for any period exceeding:-
In the case of a passenger vehicle, a station wagon, a light goods vehicle or a motorcycle – 10 hours in any one period of 24 consecutive hours.
6. Car Parks
(a) a person shall not use a car park for any purpose other than for the parking of mechanically propelled vehicle
(b) paragraph (a) of this Bye-Law shall not operate so as to prohibit casual trading in accordance with the provisions of the Casual Trading Act, 1995, where such trading is duly authorised by the Council
(c) where a vehicle other than a motorcycle is parked in a car park during business hours a valid pay and display ticket shall be clearly exhibited in the interior of the vehicle, so long as the vehicle is parked in that car park.
7. Pay and Display Ticket Parking
The following provisions shall apply during business hours to the parking of a vehicle in a ticket parking place-
(a) a vehicle which is parked in a ticket parking place during business hours shall, where parking bays are provided at that ticket parking place be parked within the area comprising a parking bay
(b) a vehicle shall not be parked in a buffer area (i.e. an area between designated parking places)
(c) a vehicle parked in a ticket parking place, at any time which is not during business hours shall be removed from the ticket parking place when a period of business hours commences, unless at such commencement and during the remainder of the period of parking, a valid pay and display parking ticket is exhibited in the interior of the vehicle in accordance with Bye-Laws and these Bye-Laws shall apply from such commencement in respect of such parking
(d) where a vehicle being parked in a ticket parking place during business hours is a goods vehicle being so parked solely for the loading or unloading of goods, Bye-Law 8 shall not apply until the expiration of 30 minutes after the commencement of the parking.
Notwithstanding paragraph (a) of this Bye-Law, a vehicle parked in a parking bay during business hours may project into and adjoining buffer area if the length of the vehicle prevents its being parked wholly in accordance with paragraph (a) of this Bye-Law.
This Bye-Law shall not apply to a parking bay when the pay and display parking ticket machine for that parking bay is temporarily suspended from operation.
8. Parking Fees
Shall be as set out in Appendix 1.
9.
Period of Parking in Ticket Parking PlaceShall be as set out in Schedules I to VII.
10. Permitted Practices in Car Parks
(a) a person shall not overhaul or carry out repairs to a vehicle while it is parked in a car parked save where it is necessary to do so in order to enable the vehicle to be removed from the car park
(b) a vehicle while parked in a car park shall not be used for the sale of goods, tickets or any service in or from the vehicle, or as an office, nor shall any such vehicle be offered or displayed for sale or for hire or as a prize, unless prior written permission has been received from the Council
(c) a motorcycle or pedal cycle shall not be parked during business hours in a ticket parking place.
PARKING PERMITS FOR RESIDENTS
11. Definitions
In this part of these Bye-Laws-
“owner” means a resident by whom a vehicle is habitually kept and used;
“resident” means a person whose normal dwelling place is at a premises situated adjoining a public road in a ticket parking area
“permit” means a document issued by the Council for the purpose of Bye-Laws containing the particulars specified in Bye-Law 12
“valid permit” means a resident’s parking permit which relates to a particular street or streets and to a period which has not expired and which is issued by the Council
“vehicle” means a private motor car, a station wagon or a passenger vehicle having accommodation for not more than seven passengers excluding the driver.
12. Particulars of Resident’s Parking Permit
A resident’s parking permit shall contain the following particulars –
(a) name of the Council by whom it is issued
(b) the registration number of the vehicle in respect of which it is issued
(c) the date of issue
(d) the street or streets to which it relates
(e) the period to which it relates, including the date of expiry
(f) the signature of the officer of the Council issuing it
13. Permission to Park Vehicle Displaying Resident’s Permit
The display, in accordance with Bye-Law 14 of a valid resident’s parking permit on the vehicle in respect of which the permit was issued, shall permit the owner of the vehicle (or any person using it with his/her consent) to park it without limitation as to time in a pay and display parking place in a road to which the permit relates.
14. Display of Resident’s Parking Permit
A valid resident’s parking permit shall be so displayed in the interior of the vehicle in respect of which it is issued that it can be read from outside the vehicle.
15. Return and Transfer of Resident’s Parking Permit
Where, during the period to which a resident’s parking permit relates, the holder ceases to reside at the address notified to the Council at time of issue of the permit or ceases to be an owner by disposing of the vehicle to which the permit relates, he/she shall return the residents parking permit to the Council.
16. Parking Permits for Disabled Drivers
(1) This Bye-Law applies to a mechanically propelled vehicle the registered owner and the driver of which is a disabled person.
(2) The Council may grant to a disabled person a permit in writing under this Bye-Law.
(3) The following provisions apply to a permit under this Bye-Law:
(a) application for the permit shall be made in writing to the Council in respect of the parking of the specified vehicle in the functional area of the Council
(b) the permit shall be for such period, not exceeding one year, as may be specified in the permit and may, at the permission of the Council, be extended from the date of expiry for another period not exceeding one year
(c) the permit shall be prominently displayed on the vehicle in respect of which it is granted when that vehicle is parked in a pay and display parking place during business hours.
(4) In this bye-law:
“disabled person” means a person who is suffering from a permanent disability that prevents the person from walking or causes undue hardship to the person in walking
“specified vehicle” means a mechanically propelled vehicle the registered owner of which is a disabled person.
AUTHORISED PERSONNEL
17.
Every person using a car park shall comply with any lawful direction given by an officer or employee of the Council authorised for the purpose of these Bye-Laws by the Council, or by a member of the Garda Sìochàna in relation to the parking of a vehicle, or its removal from a car park or in relation to any of these Bye-Laws.
18.
Where a person who is in breach of any of these Bye-Laws is requested by an officer or employee of the Council or a member of the Garda Sìochàna to leave a car park he/she shall comply with such a request.
19.
A person shall not in any car park wilfully obstruct, disturb or interrupt an agent, officer or employee of the Council in the execution of his or her duty, including the execution of any work in connection with the laying out or maintenance or any part of a car park by the Council or its agents.
A person shall give on demand to an officer or employee of the Council (authorised for the purposes of these Bye-Laws by the Council) his or her name and address, and a person shall not in any car park resist, obstruct, or aid or incite any person to resist or obstruct an officer or servant of the Council in the execution of his or her duty or lawful exercise of his or her authority.
An officer or employee of the Council shall produce, if requested to do so, evidence of his identity and employment by the Council, to any person alleged by him to be in breach of these Bye-Laws, or who has been requested to leave the car park under Bye-Law 18.
All previous Athy Town Council Traffic and Car Park Bye-Laws are hereby revoked.
These Bye-Laws shall be known as the Athy Town Council Traffic and Car Park Bye-Laws, 2002.
